Acceptable Use Policy - see also Terms of Service

Use of Neon Pages services constitutes acceptance and agreement to the Terms of Service inclusive of this Acceptable Usage Policy:

1. Subscriber may not under any circumstances use Neon Page's services or equipment for any of the following or similar activities:

a) Upload, post, email, link to, distribute, or allow to be distributed unsolicited commercial email, bulk email, chain letters, pyramid schemes, or other forms of "spam". Distribution to opt-in subscriber mailing lists are allowable only if legitimate signup records are kept and furnished upon request.

b) Rent, sell, or otherwise distribute bulk mailing lists; nor sell, instruct, or otherwise promote "spamming" in any way whatsoever.

c) Forge any TCP/IP packet header or any part of the header information in any email or newsgroup posting.

d) Upload, post, email, distribute, or allow to be distributed any copyrighted material without license or express written permission from the copyright holder. This includes but is not limited to software, music, videos, photos, artwork, graphics, text, link lists, and any other tangible or intellectual property belonging to someone else.

e) Upload, post, email, link to, distribute, or allow to be distributed any illegal material including but not limited to computer viruses, illegal hacking programs, "Warez", child pornography, hate speech, "snuff" films, images or depictions, or any other illegal activities; nor sell, instruct, describe or promote these or any other illegal activities in any way whatsoever.

f) Promote or allow to be promoted any website included in the Service Plan Agreement using bulk or unsolicited email, or by making multiple or inappropriate postings to newsgroups, message boards, or any other public forums. Any promotion of Subscriber's website on other websites or public forums must be made in accordance with Neon Pages Terms of Service as well as the Terms of Service and any other policies in effect at said website or forum.

g) Access or attempt to access any data or resource not intended for Subscriber, nor attempt to log on to a server or account which Subscriber is not authorized to access, nor take any action in order to obtain services to which Subscriber is not entitled, nor attempt to probe, scan or test the vulnerability of any system or network, nor attempt to breach the security or authentication measures of any system or network without proper authorization.

h) Attempt to interfere with service to any user, host or network, including but not limited to, overloading, "flooding", "mail bombing" or "crashing".

i) Mislead or misrepresent his/her/their identity for any reason including but not limited to commit or attempt to commit fraud; nor to lure or attempt to lure minors for any reason through any website, chatroom, message board, or other means.


2. Subscriber must request and receive specific permission before using Neon Pages's services or equipment for any of the following or similar activities:

a) Act as a reseller of website hosting or domain name registration services.

b) Upload or post pornography or adult-oriented websites or related material including but not limited to thumbnail gallery posts ("TGPs") and URLs programmed to open other websites whether by referrer, use of frames, or other methods.

c) Upload, post, install or attempt to install MP3 music files, message boards, chatrooms, IRC servers, live webcams, "bots", game servers, and any other programs or multimedia which might be considered a drain of server resources, nor participate in public "file-sharing" systems using files stored on or received through Neon Pages' servers.

d) Install or attempt to install RealAudio or RealVideo servers or streams, dedicated IP address(es), online shopping cart(s), merchant or payment system(s), members-only area(s), secure site protocols or "SSL", MySQL or other databases, or any other optional add-ons not included in the Service Plan Agreement.


3. Any website that gathers personal information and is aimed at or intended for children, or in which children may be interested and likely to visit, must comply with the Children's Online Privacy Protection Act (COPPA). More information can be found at the Federal Trade Commission website.


4. ANY VIOLATION OF THIS ACCEPTABLE USE POLICY MAY RESULT IN IMMEDIATE TERMINATION OF SERVICES WITHOUT NOTICE OR REFUND. FURTHER, ANY VIOLATION MAY BE REPORTED TO ANY OTHER INTERNET SERVICE PROVIDER(S) AND/OR LAW ENFORCEMENT AGENCIES, AND MAY RESULT IN CIVIL AND/OR CRIMINAL PROSECUTION.
